PHCA Blog: The MTRCB denied It’s Showtime’s MOR?

LOOK: The Movie and Television Review and Classification Board (MTRCB) has rejected the motions for reconsiderations in relation to It’s Showtime‘s 12-day suspension that has been issued by the board in September 4, 2023.

As per official statement issued by the said governing body, they have released a resolution dated today, September 28, 2023, that the Reconsideration Motions for

Its Showtime – which was airing on Kapamilya ChannelKapamilya Online Live, A2Z, GTV and Jeepney TV, was REJECTED. This Reconsideration Motion was filed by GMA Network and ABS-CBN Corporation.
As per MTRCB’s statement, the said motion of reconsiderations has sought relief from the Board’s ruling dated August 17, 2023, in relation to the July 25, 2023 episode of the live noontime television program “It’s Showtime!” Specifically, during the show’s “Isip Bata” segment, in which hosts Ryan Bang, Vice Ganda and Ion Perez allegedly acted indecently or inappropriately in the presence of children, which is alleged to have violated Chapter IV Section 2 (b) (1) of the 2004 Implementing Rules and Regulations (IRR) of the Presidential Decree (PD) No. 1986. In line with this, the BD dated 17 August 2023 is still affirmed.

Let’s recall that on September 4, 2023, the MTRCB has issued a 12-day suspension against It’s Showtime, after a number of complaints has been received against the show, including for the July 25, 2023’s episode, during the segment of “Isip Bata”, following the inappropriate acts in an indecent manner, as well as the other complaints, cases and warnings against the show (including during it’s broadcast on TV5), such as:

1. An inappropriate utterance of the an inappropriate word done by the hosts Jhong Hilario and Vice Ganda, during the January 24, 2023 episode of “It’s Showtime!” in violation of Section 2 (B), Chapter IV of the Implementing Rules and Regulations of Presidential Decree (P.D.) No. 1986*.
2. An inappropriate utterance of the an inappropriate word done by the host Vhong Navarro, during the June 3, 2023 episode of “It’s Showtime!” which is a clear violation of Section 2 (B), Chapter IV of the Implementing Rules and Regulations of P.D. No. 1986**.
3. A prior warning in relation to the utterance of a sexually explicit term on their January 9, 2023 episode.
4. A prior warning in relation to the indecent attire and performance which was done by Kim Duenas during the “Girl on Fire” segment that was aired on February 14, 2023.

A day after (September 5, 2023) the board has issued this suspension order, It’s Showtime continued to air on their channels where this was broadcast, while the decision in relation to the order is not finalized. ABS-CBN filed a Motion for Reconsideration related to it.

This was not their first time to issue a preventive suspension order, since in 2010, the MTRCB has issued a 20-day preventive suspension on ABS-CBN’s daily variety program then called “Showtime.”

Per the board’s charter, as part of the Presidential Decree no. 1986, the respondents may file a motion for reconsideration within fifteen (15) days from the time that this receipt of decision was issued. Since the Board’s Decision (BD) we’ve said earlier was rejected recently, the next step is to appeal to the Office of the President from the time of it’s rejection of it.

*This case’s decision is that they have found the Respondents (ABS-CBN Corporation, ZOE Broadcasting Network, Inc. and TV5 Network, Inc.) remiss in the performance of their respective functions and duties required under the Implementing Rules and Regulations (IRR) of P.D. No. 1986, specifically Section 2 (B) Chapter IV thereof, and are admonished to refrain from making any utterances of similar nature for the same will be dealt more severely. TV5 Network, Inc. simulcasted It’s Showtime from the period of July 16, 2022 to June 30, 2023. It was later moved to GTV the following day later, with TV5 premiered E.A.T. on July 1, 2023.
**This case’s decision is the derelict in the performance of their respective functions and duties under the IRR of P.D. No. 1986, Respondents (ABS-CBN and ZBNI) were sternly warned by the Board that a similar utterance will be dealt with more severely.
